Anagen LLC and its affiliates ("Anagen," "the Company," "we," "us," or "our") is committed to respecting the privacy and recognizing the need for appropriate protection and management of our users' personal information of the services provided by us through our website at www.anagen.xyz (collectively, the “Services”). When we do need your personal information to provide services that you request or when you choose to provide us with your personal information, this policy describes how we collect and use your personal information. This Policy does not describe how we collect or use your Protected Health Information as defined by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), which is covered by our Notice of HIPAA Privacy Practices (“HIPAA Notice”). For clarity, the HIPAA Notice, not this Privacy Policy, explains our privacy practices with respect to your Protected Health Information.
This Privacy Policy is incorporated into our Terms of Use. By using the Services, you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Services. Where the law requires your consent for a particular use of your information, we ask for it separately.
Information We Collect
Information you provide. We collect information you give us, for example when you create an account, place an order, complete a medical questionnaire, join a waitlist, sign up for updates, or contact us. Depending on the Services you use, this can include your name, email address, phone number, postal address, date of birth, payment information (collected by our payment processor), order history, the treatments you are interested in, your answers to questionnaires, and the content of your communications with us. If you join our international waitlist, we also collect your country, how you heard about us, and how likely you would be to buy.
Information collected automatically. When you use our website, we and our service providers collect information such as your IP address, browser and device information, approximate location (such as your state or country, based on network information), the pages you view, the links you click, the date and time of your visit, and how you arrived at our site, including the link, ad, campaign, or referral or promo code you used. We collect this information using cookies, pixels, and similar technologies, as described in our Cookie Policy.
Information from others. We receive information from health care providers and pharmacies involved in your care, from our payment processor, and from affiliate and referral partners.
We do not access or store information that you have saved on your computer or mobile device such as contacts and appointments. However, in order to provide our services, our website may interact with some features on your mobile device, such as your GPS locater. In such case, we will ask for your consent with respect to identifying your location.
How We Use Information
We may use your information to:
- Provide and manage the Services, including processing orders and payments, facilitating care from health care providers and pharmacies, managing waitlists, and providing customer support.
- Analyze and improve the Services, including understanding how people use our site, measuring demand for our products in different places, and developing new features.
- Advertise and market, in accordance with applicable law, including sending you information about our products, services, and promotions, showing you more relevant ads for Anagen on other websites and apps, and measuring how well our advertising works.
- Protect Anagen and others and meet legal obligations, including preventing fraud, securing the Services, enforcing our terms, and complying with law.
Aggregate and de-identified information. We may aggregate or de-identify information so that it can no longer reasonably be linked to you, and use or disclose that information for any lawful purpose. We will not attempt to re-identify it.
Analytics and Advertising
Analytics. We use our own analytics and third-party analytics services, such as Google Analytics, to understand how people use our site and to improve it. These tools may record the pages and products you view and the actions you take on our site.
Advertising. We work with advertising partners, such as Meta, Google, TikTok, Reddit and X, to measure our advertising and to show you more relevant ads for Anagen on other websites and apps. When advertising is permitted, these partners may receive cookies and similar identifiers, your IP address, device and browser information, hashed contact information such as your email address or phone number, information about how you arrived at our site, and events such as visiting our site, starting checkout, or completing a purchase, including its value.
Advertising partners may learn that you visited or purchased from Anagen. Because Anagen provides telehealth services, that alone may suggest an interest in health services. The information we send to advertising partners for advertising does not include the specific treatments or products you view or buy, or your answers to medical questionnaires.
If you sign up for a waitlist or for updates from us, we may also share your email address, in hashed form, with advertising partners so that they can show you ads for Anagen or reach people with similar interests.
We record how you arrived at our site, such as the link, ad, campaign, or referral or promo code you used, whether or not you allow advertising, to measure our marketing and credit referral and affiliate partners. Where we need your permission for advertising, we don't send advertising events until you give it, and we discard them if you don't.
Your advertising choices. Your choices depend on where you are:
- In the European Union, the European Economic Area, the United Kingdom and Switzerland, we use analytics and advertising technologies only if you accept them.
- In some U.S. states, we ask for your permission before sharing information with advertising partners where state law requires it, such as for certain health-related activity.
- We do not share information with advertising partners for targeted advertising when you visit from Washington or Nevada.
- Elsewhere, we may use advertising technologies unless you opt out.
You can change your choices at any time using Your Privacy Choices in our site footer. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of advertising for that browser and, if you are signed in, for your account. Choices made while signed out apply to that browser, and choices made while signed in apply to your account. Your advertising choice covers both the website and transaction information described above and the use of your email address for advertising. If you opt out, we stop sharing information with advertising partners for advertising going forward. You may still see ads for Anagen, but they may be less tailored to you.
How We Disclose Information
We may disclose your information:
- To health care providers and pharmacies, to provide care, prescriptions, and fulfillment you request.
- To service providers who perform services on our behalf, such as hosting, payment processing, shipping and fulfillment, customer support, communications, analytics, and security.
- To partners for international availability. If you join our international waitlist, we share your name, email address and country with pharmacy and other partners acting on our behalf to contact you about availability, with your consent.
- To advertising partners, as described in "Analytics and Advertising" above.
- To affiliate and referral partners, who receive the order information they need to credit referrals and pay commissions.
- To protect Anagen and others, if required by law or if we believe in good faith that disclosure is reasonably necessary to comply with legal process, enforce our terms, or protect the rights, property, or safety of Anagen, our users, or the public.
- In a business transfer. If Anagen LLC is sold to, or merges with, another company, we reserve the right to include your Personal Information among the assets transferred to the acquiring company. If so, Anagen LLC will seek to obligate the acquiring company to use any Personal Information transferred by this site in a manner consistent with this Privacy Policy, but cannot guarantee that it will be able to impose that requirement or that the acquiring company will comply.
- With your consent or at your direction.
We do not sell, share, or rent mobile phone numbers or text message consent with third parties for their own marketing purposes.
We send postal address fields to Google Maps to suggest and check addresses. These requests do not include your name, phone number, email, or treatment information. See the Google Privacy Policy.
Information from Apple HealthKit, to the extent you choose to sync your HealthKit data with Anagen, is used by our healthcare professionals and clinical support staff for purposes related to clinical care and healthcare management. We do not use or disclose HealthKit data for advertising, marketing, or other use-based data mining purposes other than improving health management.
Marketing Communications
We may send you emails about our products, services, and promotions, in accordance with applicable law. You can unsubscribe at any time using the link in any marketing email. We send marketing text messages only if you agree to receive them, and you can stop them by following the instructions in any message. You cannot opt out of service messages about your account, orders, or care.
Check-In Rewards
When you complete a treatment check-in, you can choose to let Anagen share your check-in answers and photos on our website, in marketing and on social media. We never include your name, email, face or other details that identify you. Your choice covers your check-ins until you withdraw it.
If you opt in, each check-in can earn store credit, up to the amount shown on that check-in, based on how complete and useful it is and never on whether it is positive. Opting in is optional and does not affect your care or any other reward. You can withdraw at any time by emailing privacy@anagen.xyz, and we will stop using your check-ins in new material. We set the credit by comparing it with what we would otherwise pay for similar content, such as paying creators for product testimonials.
Your Rights and Choices
If you are a registered user, you can review your personal information by signing in to your account. Depending on where you live, you may have the right to request access to, correction of, or deletion of your personal information, to receive a copy of it, and to withdraw consent you have given. To make a request, email privacy@anagen.xyz or call +1 713-673-9642. We may need to verify your identity before responding. An authorized agent may submit a request on your behalf with proof of your written permission. If we deny your request, you may appeal by replying to our response. We will not discriminate against you for exercising your privacy rights.
California Privacy Rights
Our disclosure of identifiers and online activity to advertising partners may be considered a "sale" or "sharing" of personal information under California law, even when no money changes hands. You can opt out using Your Privacy Choices or a Global Privacy Control signal. California residents may also request information about the categories of personal information we collect, the sources, the purposes, and the categories of third parties to whom we disclose it, and may request that we limit our use of sensitive personal information. This Privacy Policy describes those categories, sources, purposes, and recipients. We do not knowingly sell or share the personal information of consumers under 16. Check-In Rewards is our notice of financial incentive.
European and UK Privacy Rights
If you are in the European Economic Area, the United Kingdom or Switzerland, Anagen LLC is the controller of your personal information. We rely on your consent for analytics and advertising technologies and for our international waitlist, including your explicit consent where your information reveals an interest in health services. We process other information as needed to provide the Services you request, for our legitimate interests in securing and improving the Services, and to comply with legal obligations. Anagen operates in the United States, and your information is processed there.
You may request access to, correction, deletion, or restriction of your personal information, request a portable copy, object to processing based on our legitimate interests, and withdraw consent at any time without affecting processing already carried out. You may also complain to your local data protection authority or, in the UK, the Information Commissioner's Office.
International Visitors
Our Services, including checkout, are currently available only in the United States. Joining our international waitlist is an expression of interest, not an order or a promise that Anagen will become available in your country.
Retention
We keep personal information for as long as needed for the purposes described in this Privacy Policy, including providing the Services, meeting legal, tax, and medical recordkeeping obligations, resolving disputes, and enforcing our agreements. How long we keep it depends on the type of information, why we collected it, and our legal obligations. We may keep a record of your privacy choices to honor them.
Data Security
Your Anagen account information is password-protected for your privacy and security. We implement reasonable safeguards to protect the security of the data you send us through physical, administrative, and technical procedures. In certain areas of our websites, Anagen uses industry-standard SSL-encryption to enhance the security of data transmissions.
While we strive to protect your personal information, we cannot ensure the security of the information you transmit to us, and so we urge you to take every precaution to protect your personal data. No data transmission over the Internet or through mobile devices can be guaranteed to be 100% secure. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Change your passwords often and use a combination of letters and numbers.
Children and Privacy
Our website does not target and is not intended to attract individuals under the age of 18. Anagen does not knowingly solicit personal information from individuals under the age of 18 or send them requests for personal information. If you are under 18 then you may not use or access our website or services at any time or in any manner.
Third Parties
Our website may contain links to other websites or applications. Anagen does not share your personal information with those websites or applications and is not responsible for their privacy practices. Please note that when you click on any of these links, you are entering another website for which we have no responsibility or control. The inclusion of any link does not imply affiliation or endorsement by us of the linked website or any of the content, services or products offered on such sites. We are simply a portal and do not have access to their data. You agree that we shall not be responsible for any loss or damage of any sort incurred as a result of any such links or as the result of the presence of such links on this site. Changes to Our Privacy Policy
We may revise this Privacy Policy at any time to reflect changes in the law, our practices, or the Services. We will post the revised policy on this page with its effective date.
